VAT Non-Compliance Penalties Businesses May Face in Dubai
The FTA may impose either fixed penalties, monthly penalties or a percentage of penalties depending on the situation. Here are some of the major penalties that apply to VAT-registered companies:
- Failure to maintain the required records: AED 10,000 for the first violation and AED 20,000 for a repeated violation.
- Failure to provide tax records in Arabic when requested: AED 20,000.
- VAT registration after due date: AED 10,000.
- Inability to update tax registration information: AED 5,000 for the first offense and AED 10,000 for the next offense.
- As for late filing of VAT return: AED 1,000 for the first violation and AED 2,000 if repeated within 24 months.
- Late payment of VAT: 2% of the unpaid tax on the day following the payment deadline, followed by 4% for each month or part of a month after one month. The total may reach 300% of the unpaid amount
- Submission of an incorrect VAT return: AED 1,000 for the first violation and AED 2,000 for repetition. Where the tax difference is lower than the fixed penalty, the penalty equals the difference, subject to a minimum of AED 500. This fixed penalty does not apply if the return is corrected before the payment deadline.
- Voluntary disclosure within one year: 5% of the tax difference.
- Voluntary disclosure during the second year: 10% of the tax difference.
- Voluntary disclosure during the third year: 20% of the tax difference.
- Voluntary disclosure during the fourth year: 30% of the tax difference.
- Voluntary disclosure after the fourth year: 40% of the tax difference.
- Failure to disclose an error before receiving an FTA audit notice: 50% of the error, plus 4% for every month or part of a month on the unpaid tax or ineligible refund.
- Failure to cooperate with an FTA tax auditor: AED 20,000.
- Failure to account for VAT on behalf of another person when required: Late-payment penalties may apply, reaching up to 300% of the unpaid tax.
- Failure to account for VAT due on imported goods: 50% of the unpaid or undeclared tax.
- Failure to display VAT-inclusive prices: AED 5,000.
- Failure to notify the FTA before applying the profit margin scheme: AED 2,500.
- Failure to follow the rules for keeping or moving goods in a designated zone: The higher of AED 50,000 or 50% of the VAT chargeable on the goods connected with the violation.
